1. Acceptance of Terms
By accessing and using the Deutsch-Landia platform, you agree to these Terms and Conditions. If you do not agree, please do not use the platform. Deutsch-Landia is an educational platform for learning German, for learners of all ages — children, teenagers and adults.
2. Your account
You are responsible for the security of your account. Do not share your login credentials with others. If you are a parent creating an account for your child, you are responsible for their activity.
- Password must be at least 8 characters
- A valid email is required for account recovery
- Accounts inactive for more than 12 months may be deleted
3. Subscriptions and Payments
Deutsch-Landia offers free and paid plans. Payments are processed by Stripe, a PCI-DSS certified payment provider. We do not store your card data.
- Subscriptions renew automatically monthly or annually
- You can cancel at any time from your account settings
- Refunds are offered within 14 days of payment
- Prices may change with 30 days prior notice
4. Digital content — Waiver of withdrawal right (OUG 34/2014 Art. 16(m) / EU Directive 2011/83/EU Art. 16(m))
Under Romanian Emergency Ordinance 34/2014 (transposing EU Directive 2011/83/EU), distance contracts normally entitle the consumer to a 14-day cooling-off period to withdraw without reason.
Exception for digital content: Per OUG 34/2014 Art. 16(m), the 14-day withdrawal right does NOT apply to "contracts for the supply of digital content which is not supplied on a tangible medium" if:
- Performance has begun with your express prior consent, AND
- You have expressly acknowledged that, by giving this consent, you lose your right of withdrawal.
When purchasing a Deutsch-Landia subscription, you will be asked to confirm explicitly, by ticking the checkbox at checkout, both of the following:
- "I request immediate provision of Deutsch-Landia digital content (access to lessons, exercises, vocabulary)" — express prior consent
- "I agree that by this confirmation, I waive my 14-day right of withdrawal under OUG 34/2014 Art. 16(m) / EU Directive 2011/83/EU Art. 16(m)" — explicit waiver acknowledgement
The checkbox must be ticked to complete checkout. Stripe records your acceptance alongside the payment, and the moment you accepted these Terms is kept on your account.
Important: This waiver does NOT affect:
- Your right to refund for defective or non-conforming content (Romanian Civil Code + OG 21/1992)
- Statutory guarantees (max. 2 years for goods, service conformity)
- Our voluntary commercial 14-day refund policy (separate, our commercial decision — see "Subscriptions and Payments" section)
5. Acceptable Use
It is prohibited to:
- Share account access with third parties
- Use the platform for unauthorised commercial purposes
- Reproduce or distribute content without permission
- Use automated tools (bots) to access the platform
6. Intellectual Property
All content on Deutsch-Landia (lessons, exercises, stories, illustrations, mascots) is the property of IACOB MIHAI-ALBERTO PFA (Romanian fiscal code (CUI) 54802933) or our partners, and is protected by copyright. We grant you a personal, non-exclusive licence to use the platform for educational purposes.
7. Limitation of Liability
Deutsch-Landia does not guarantee that the platform will be available 100% of the time. We are not liable for indirect or consequential losses resulting from use of the platform.
8. Governing Law and Dispute Resolution
These terms are governed by Romanian law. If you are a consumer, that choice cannot take away any right the law of your own country gives you anyway:
- If you are a consumer habitually resident in another EU member state, choosing Romanian law does NOT deprive you of the mandatory protections of your own law (Regulation (EC) No 593/2008 "Rome I", Article 6(2)).
- You may bring proceedings against us either in the Romanian courts or in the courts where you live. We may bring proceedings against you ONLY in the courts where you live (Regulation (EU) No 1215/2012 "Brussels I bis", Article 18).
- Before court: write to legal@deutsch-landia.com, and if we cannot resolve it you may contact ANPC, the Romanian consumer protection authority. ANPC and alternative dispute resolution (SAL) contact details are in the footer of every page.
- For institutional customers (schools, companies), who are not consumers, Romanian law applies and the competent courts are those of our registered office.
